On 27 February 2024, the European Parliament adopted the Regulation on the transparency and targeting of political advertising, including local operation requirements. The Regulation outlines transparency obligations concerning political advertising, including advertising displayed on online platforms, mobile applications, websites and other digital interfaces. In particular, the Regulation would require providers of political advertising services that do not have an establishment in the EU to appoint a legal representative in the Member State where they are providing their services. The Regulation is sent to the Council for adoption and will take effect 18 months after being enacted. The definitions and regulations regarding the fair provision of cross-border political advertising, including for European political parties and groups, will be implemented 20 days after being published in the EU Official Journal.
