On 31 October 2025, the Law on Digital Transformation was introduced to the National Assembly of Vietnam. The Law on Digital Transformation applies to organisations and individuals directly involved in or related to digital transformation in Vietnam under Article 2. Provisions relevant to fair marketing and advertising practices are limited. Article 38(1) requires owners of digital systems and digital platforms to publicly and transparently disclose the code of conduct, terms and conditions of use, complaint handling mechanisms, and policies for protecting user rights. Article 41(5) provides that users have the right to choose whether to use or discontinue using digital products and services based on being provided with complete, clear, accurate, transparent, and timely information about terms and conditions of use, and not to be subjected to unreasonable conditions or discrimination. Article 43(4) requires digital content products containing content harmful to children to have warning signs.
