On 4 June 2025, the US Court of Appeals for the Ninth Circuit denied Apple Inc.’s emergency motion for a partial stay pending appeal in the case Epic Games, Inc. v. Apple Inc. (No. 25-2935). The court considered factors for granting a stay, specifically whether the applicant demonstrated a likelihood of success on the merits, potential irreparable injury without a stay, potential injury to other parties, and where the public interest lies. The court noted that Apple carried the burden of showing circumstances warranting its discretion. Upon review of the relevant factors, the court determined that a stay was not appropriate. Separately, the court granted all outstanding motions for leave to file amicus briefs.
