On 14 March 2023, the European Parliament adopted on the first reading a version of the text of the Data Act (Regulation on harmonised rules on fair access to and use of data) in preparation for negotiations with the Council. The Act includes requirements for international data transfers of non-personal data and states that data processing service providers must take technical, legal and organisational measures to prevent the international transfer or governmental access to non-personal data which would breach national or EU law. In particular, the EU Commission would be able to adopt a list of jurisdictions where the transfer of such data could create a conflict with European Union law. The European Parliament will now enter into negotiations with the Council regarding further progress in the legislative process.
