On 29 December 2022, the State Antitrust Enforcement Venue Act of 2022 entered into force after being signed into law by the US President on the same day. The State Antitrust Enforcement Venue Act of 2022 was incorporated into the Consolidated Appropriations Act 2023 (HR 2617) under the name Venue for State Antitrust Enforcement. In particular, the Act prohibits companies from requesting to move antitrust cases to other preferred courts. Currently, civil actions which are simultaneously tried before different federal courts on similar issues may be transferred to one court to consolidate the whole proceeding and subsequent results. This Act would limit such actions for antitrust cases.
