On 8 October 2025, the Governor of California signed the Bill amending the California Consumer Privacy Act of 2018 to add an opt-out preference signal requirement. The Act applies to businesses that develop or maintain internet browsers, requiring them to include a function easily accessible to consumers that enables the browser to send an opt-out preference signal to businesses with which the consumer interacts through the browser. Such businesses must publicly disclose how the signal functions and its intended effect. The California Privacy Protection Agency is authorised to adopt implementing regulations. A business that develops or maintains a browser with this functionality is not liable for violations committed by businesses receiving the signal. The Act will enter into force on 1 January 2027.
