On 11 September 2025, the California Assembly concurred with Senate amendments to the Bill amending the California Consumer Privacy Act of 2018 to include an opt-out preference signal. The Bill applies to businesses that develop or maintain internet browsers, requiring them to include an easily accessible functionality configurable by a consumer that enables the browser to send an opt-out preference signal to businesses with which the consumer interacts through the browser. These businesses must also publicly disclose how the signal functions and the types of personal information it covers. The California Privacy Protection Agency is authorised to adopt regulations to implement the Act. A business that develops or maintains a browser that includes a functionality enabling the browser to send an opt-out preference signal pursuant to this section shall not be liable for a violation of this title by a business that receives the opt-out preference signal. The Bill, if signed by the Governor, will enter into force on 1 January 2027.
