On 12 February 2025, a Bill to amend the California Consumer Privacy Act of 2018 to include an opt-out preference signal (AB 566) was introduced to the California Assembly. The Bill would prohibit companies from developing or maintaining browsers and mobile operating systems that do not include a setting that allows consumers to send an opt-out preference signal to companies they interact with. An opt-out preference signal is a technical mechanism that automatically communicates a consumer's decision to opt out of the sale and sharing of their personal information in accordance with California privacy laws. This setting must be easy to find and configure. The browser requirement would take effect immediately, while the mobile operating system requirement would take effect six months after the California Privacy Protection Agency (CPPA) adopts regulations outlining the technical specifications. The CPPA would also have the authority to update the definitions and address technological and privacy concerns.
