Notice-and-removal obligations for platforms under the TAKE IT DOWN Act (SB 146/Law No. 119-12) enter into force

On 19 May 2026, the one-year grace period under the Tools to Address Known Exploitation by Immobilising Technological Deepfakes on Websites and Networks (TAKE IT DOWN) Act (Public Law No: 119-12) will expire. The Act, which entered into force on 19 May 2025, requires platforms that host user-generated content and make it publicly accessible to implement a notice-and-removal mechanism enabling identifiable individuals or their authorised representatives to request the removal of non-consensual intimate visual depictions. From 19 May 2026, covered platforms must make reasonable efforts to remove the reported content and any known identical copies within 48 hours of receiving a valid notice. The Federal Trade Commission (FTC) is responsible for enforcement.
