On 18 June 2024, the Tools to Address Known Exploitation by Immobilizing Technological Deepfakes on Websites and Networks (TAKE IT DOWN) Act was introduced to the US Congress. The Act aims to prevent the dissemination of non-consensual intimate imagery (NCII), including deepfake content generated by artificial intelligence. It criminalises the intentional publication of NCII on social media without the consent of the depicted individual. Online platforms must establish processes to remove NCII within 48 hours of a request from depicted individuals and make reasonable attempts to eliminate copies of this content. The Act also includes provisions related to free speech and expression, ensuring that the Act's scope is limited to the offending material.
