On 3 January 2025, the Tools to Address Known Exploitation by Immobilising Technological Deepfakes on Websites and Networks (TAKE IT DOWN) Act was rejected after failing to pass before the 118th Congress adjourned. The Act aimed to prevent the dissemination of non-consensual intimate imagery (NCII), including deepfake content generated by artificial intelligence. It would have criminalised the intentional publication of NCII on social media without the consent of the depicted individual. Online platforms would have had to establish processes to remove NCII within 48 hours of a request from depicted individuals and make reasonable attempts to eliminate copies of this content. The Act also included provisions related to free speech and expression, ensuring that the Act's scope is limited to the offending material.
