On 10 July 2024, Tools to Address Known Exploitation by Immobilizing Technological Deepfakes on Websites and Networks Act (TAKE IT DOWN Act/HB 8989) was introduced at the United States Congress. The Act seeks to address the distribution of non-consensual intimate imagery (NCII), particularly targeting online platforms and individuals involved in disseminating NCII, including artificial intelligence (AI)-generated deepfakes. The Act criminalises the publication or threat to publish NCII in interstate commerce, mandates that websites remove NCII within 48 hours of a valid request from a victim, and requires reasonable efforts to remove copies, with enforcement by the Federal Trade Commission.
