Parliament adopts position on interoperability requirement in DMA

On 15 December 2021, the European Parliament adopted the text of the Digital Markets Act (DMA). The approved text includes several amendments regarding the interoperability requirement. The parliament amended the Commission proposal to include that gatekeepers should provide free of charge access to and interoperability with the same operating systems used by the gatekeeper to providers of ancillary services, understood as services offered in connection to or with the core platform services. Furthermore, the Parliament also included that gatekeepers should not be prevented from implementing measures to ensure that interoperability doesn't negatively impact the integrity of the operating systems, cyber security and protection of the end-user data. The Parliament will start the negotiations with the EU Council on the DMA in the first quarter of 2022 under the French presidency of the Council.
