On 16 February 2021 the Assembly Bill No. 694 (AB 694) was introduced to the California Assembly. It aims to amend the California Privacy Rights Act of 2020 (CPRA) and make technical changes to three sections of the California Civil Code. AB 694 amends sections 1798.140 to include definitions for advertising and marketing, consent, contractor, and household. Furthermore, it corrects the discrepancy between section 1798.100.40 and 1798.185 to clarify the timing for the California Privacy Protection Agency’s rulemaking authority. The Agency is required under the CPRA to “exercise its authority to adopt regulations beginning the later of July 1, 2021, or six months after the agency provides notice to the Attorney General that it is prepared to begin rulemaking”. The AB 694 states that it should be the later of the two dates. The bill will be implemented if it is enacted alongside the bill AB 335.
