On 20 October 2023, the US Supreme Court granted an application for stay in the case Murthy v Missouri until it issues a judgment. In particular, the Supreme Court temporarily blocked the lower court’s order limiting executive branch officials’ discussions with social media companies about online content. The case was first ruled on 4 July 2023 by the District Court for the Western District of Louisiana, appealed on 8 September at the 5th Circuit Court of Appeals in New Orleans, and later modified on 3 October 2023 also at the 5th Circuit Court of Appeals in New Orleans. In his dissenting view, judge Alito stated that the judgement can be expected in late spring 2024, and the Government only offered hypothetical statements in its application, instead of making a “clear showing of irreparable harm" if the stay would not be granted.
