Opened consultation on Microsoft’s submission on material change of circumstances in Microsoft/Activision merger
On 31 July 2023, the UK's Competition and Markets Authority (CMA) opened a public consultation until 4 August 2023 on Microsoft's submission concerning a material change of circumstances regarding the takeover of Activision Blizzard. In particular, Microsoft supports the change of circumstances in the acceptance by the European Commission of binding commitments offered by Microsoft and an agreement reached with Sony which ensures access to “Call of Duty” which will enhance competition in the cloud gaming market. Finally, Microsoft argues that significant new material has become available as a result of the investigation conducted by the US Federal Trade Commission into the transaction which has been recently concluded.
