On 1 December 2022, the Federal Trade Commission (FTC) opened public comments on a proposed order for a consent agreement related to iHeartMedia and Google's violations of federal law prohibiting unfair or deceptive acts or practices until 3 January 2023. The order is related to the lawsuit by the US Federal Trade Commission (FTC) and several state attorneys general against Google and iHeartMedia for deceptive endorsements of Google's Pixel 4 phone between 2019 and 2020 in ten large markets. The FTC alleged that over 29'000 advertisements from radio personalities and influencers who did not own or use a Pixel 4 phone were recorded and aired in ten large markets, violating violated Section 5(a) of the FTC Act 15 U.S.C. 46(f). The proposed order will require Google, among other things, to file a compliance report with FTC and retain records related to demonstrating compliance with the order. Following the consultation FTC will review the order and comments received to decide if it should withdraw or finalise the order.
