Adopted criteria for the selection of cases of “strategic importance” for closer cooperation

On 14 July 2022, the European Data Protection Board (EDPB) adopted a set of criteria for the selection of cases of “strategic importance” for data protection and allow strategic enforcement cooperation between European Data Protection Authorities on the EU level. The strategic cases can be proposed by any European Supervisory Authority whenever a case overlaps with other areas of law, affects a large number of data subjects in more than one Member State, involves a large number of complaints in several Member State, posing a high risk under the GDPR or a structural or recurrent problem in the several Member States. The EDPB will determine which of the proposed cases will be considered as being of “strategic importance” and it will open an investigation.
