Federal Supreme Court issues judgment in Uber v Canton Geneva over employer status classification

On 30 May 2022, the Federal Supreme Court (Bundesgericht) of Switzerland issued its judgment in the case between Uber and Canton Geneva on the issue of Uber's classification as a transport company. In its judgment, the Federal Supreme Court refused to overturn the Geneva Court of Justice's decision of 17 November 2020 that Uber is properly classed as a transport company. As a result, Uber's relationship with its drivers within Canton Geneva is an employer-employee relationship, requiring the company to pay social security contributions and extend employment protections to its drivers.
