Opened consultation on the review of the Guidelines for processing personal data across borders

On 9 April 2019, the Office of the Privacy Commissioner of Canada (OPC) opened a consultation to revisit its "Guidelines for processing personal data across borders" to update the transborder data flows regime under the Personal Information Protection and Electronic Documents Act (PIPEDA). In particular, the review involves cross-border data transfers between personal data controllers and processors and among organizations. The key points of consultation involve the type of consent companies require to disclose personal information across a border, the information available to individuals that do not want to disclose their personal information across borders, and the concept of control of information by an organisation. The consultation will be closed on 28 June 2019.
