On 8 September 2023, Latombe filed a lawsuit against the European Commission requesting an emergency suspension of the execution of the Adequacy decision for the EU-US Data Privacy Framework. He made this request on the grounds that it was urgent the Commission suspend the decision, finding that the United States ensured an adequate level of personal data protection to avoid serious and irreparable harm. The plaintiff, Latombe, a French national, claimed that his personal data could be transferred to organisations in the US without any "additional control" on compliance with the EU General Data Protection Regulation. In the plaintiff's opinion, the United States does not ensure an adequate level of data protection.
