On 12 October 2023, the General Court of the European Union rejected the application for interim measures to suspend the Adequacy Decision from 10 July 2023, requested by a French national. In the lawsuit requesting suspension of the execution of the Adequacy decision for the EU-US Data Privacy Framework (Latombe v Commission), the plaintiff claimed that his personal data could be transferred to organisations in the US without any "additional control" on compliance with the EU General Data Protection Regulation. In the plaintiff's opinion, the United States does not ensure an adequate level of data protection. The General Court found that the plaintiff did not provide reasons on how the data transfer could cause him serious harm and rejected the request for interim measures.
