State Administration for Market Regulation closes consultation on rules on internet platform pricing behaviour

On 22 September 2025, the National Development and Reform Commission (NDRC), the State Administration for Market Regulation (SAMR), and the Cyberspace Administration of China (CAC) close the consultation on the draft rules on internet platform pricing behaviour. The draft defines price conduct to include the formulation, alteration, display, and collection of prices and subsidies, and sets out principles of legality, fairness, transparency, voluntariness, and equality. It addresses self-pricing rights, prohibits algorithmic price discrimination, collusion, and hoarding, and establishes obligations regarding promotions, subsidies, and consumer protections related to automatic renewal and bundling. It also introduces requirements for compliance systems, algorithm filing, and cooperation with supervisory authorities, with provisions intended to apply for five years from entry into force. The draft aims to promote the structured development of the platform economy and has been formulated in line with the Price Law, the E-Commerce Law, the Anti-Unfair Competition Law, the Consumer Rights Protection Law, the Cybersecurity Law, and the Personal Information Protection Law of the People’s Republic of China.
