European Commission issued its preliminary finding that TikTok is in violation of Digital Service Act’s obligation to provide a searchable and reliable repository for advertisements

On 15 May 2025, the European Commission issued preliminary findings against TikTok over advertisement repository breach under the Digital Services Act (DSA), concluding that the company’s repository does not meet transparency requirements applicable to Very Large Online Platforms. The Commission found that TikTok fails to provide adequate information on advertisement content, targeting criteria, and sponsors, and that its repository lacks comprehensive search functionality, limiting its utility for researchers and civil society. The noncompliance was identified following an investigation involving internal documents, tool testing, and expert interviews. TikTok may now examine the evidence and submit a written response. If the findings are upheld, the Commission may issue a non-compliance decision, impose fines of up to 6% of global turnover, and place the platform under enhanced supervision.
