On 10 March 2025, the Bill amending the Consumer Data Protection Act to regulate social media platform use by minors (SB 854) was adopted by the Virginia General Assembly. The Bill requires platforms to implement commercially reasonable age verification mechanisms and limits minors under the age of 16 to one hour of social media use per platform per day, unless verifiable parental consent is provided to adjust the time limit. The Bill also restricts the use of data collected for age determination to that purpose alone and prohibits platforms from withholding, degrading, or increasing the price of services based on the inability to provide access beyond the permitted time limit. The Bill is set to take effect on 1 January 2026.
