Competition and Markets Authority issued ruling in its investigation into Keysight Technologies anticipated acquisition of Spirent Communications

On 9 April 2025, the Competition and Markets Authority (CMA) imposed a GBP 25'000 penalty on Keysight Technologies for failing to comply with the requirements of the First Notice without reasonable excuse. This followed a provisional penalty notice issued on 14 March 2025, in which the CMA stated its intent to impose a financial penalty under Section 110 of the Enterprise Act 2002. Keysight Technologies had initially submitted only four documents by the First Notice's deadline of 23 September 2024. After the CMA identified additional relevant documents that had not been provided, Keysight submitted seven further documents on 11 October 2024. The CMA issued a Second Notice on 29 October 2024, extending the submission period and requesting additional categories of internal documents. By 12 November 2024, Keysight had submitted 115 documents, 66 of which were responsive to the First Notice but had not been previously disclosed.
