On 3 January 2025, the 188th Congress concluded without the passage of the Eliminating Abusive and Rampant Neglect of Interactive Technologies (EARN IT) Act of 2023, introduced as H.R. 2732 in the House and S. 1207 in the Senate. Although S. 1207 was reported out of the Senate Judiciary Committee and placed on the legislative calendar, and H.R. 2732 advanced to subcommittee referral in the House, neither bill proceeded to a floor vote. As no further legislative action was taken before the session ended, both bills expired. The Act would have amended Section 230 of the Communications Decency Act, removing liability protections for interactive computer service providers in cases related to the distribution of child sexual abuse material (CSAM). It also proposed the creation of a National Commission on Online Child Sexual Exploitation Prevention to establish voluntary best practices for platforms to detect, report, and remove CSAM.
