Eliminating Abusive and Rampant Neglect of Interactive Technologies (EARN IT- S 1207) Act of 2023 was introduced to the Senate

On 19 April 2023, the Eliminating Abusive and Rampant Neglect of Interactive Technologies (EARN IT – S. 1207) Act of 2023 was introduced to the United States Senate. The bill serves as the Senate companion to H.R. 2732 and reintroduces provisions from the EARN IT Act of 2021 (S. 3538), which did not advance before the close of the 117th Congress. The Act would amend Section 230 of the Communications Decency Act, removing liability protections for interactive computer service providers in cases related to the distribution of child sexual abuse material (CSAM). It also proposes the creation of a National Commission on Online Child Sexual Exploitation Prevention to establish voluntary best practices for platforms to detect, report, and remove CSAM.
