On 19 April 2023, the Eliminating Abusive and Rampant Neglect of Interactive Technologies (EARN IT- HR 2732) Act of 2023 was introduced in the House of Representatives of the United States. The Act reintroduces the provisions outlined in the HR 3538 of 2021, which failed to pass before the Congress 117th adjourned. In particular, the Act would amend Section 230 of the Communications Decency Act to remove the immunity from liability for online platforms over the distribution of images and videos depicting child sexual abuse. Furthermore, the Act would establish a National Commission on Online Child Sexual Exploitation Prevention and empower it to develop content moderation requirements.
