On 20 February 2025, the Act on the development, deployment and use of high-risk artificial intelligence (AI) including design requirements was passed by the Senate after the House of Delegates agreed with the Senate's Bill substitute. The Act applies to developers and deployers of high-risk AI systems in Virginia. The Act provides that developers must provide detailed documentation about their AI systems, outlining limitations, performance evaluations, and measures to mitigate discrimination risks. They must also ensure transparency by disclosing AI usage to consumers, particularly in cases of adverse decisions, where they must offer opportunities for appeal. The Act exempts certain technologies and activities, such as anti-fraud systems and research, and places enforcement authority solely with the Attorney General, with penalties for violations ranging from USD 1,000 to USD 10,000.
