On 4 February 2025, a bill on the development, deployment, and use of high-risk artificial intelligence (AI) including design requirements was passed by the House of Delegates. The Act outlines the responsibilities of developers, deployers, integrators, and distributors. The Act provides that developers must provide detailed documentation about their AI systems, outlining limitations, performance evaluations, and measures to mitigate discrimination risks. They must also ensure transparency by disclosing AI usage to consumers, particularly in cases of adverse decisions, where they must offer opportunities for appeal. The Act exempts certain technologies and activities, such as anti-fraud systems and research, and places enforcement authority solely with the Attorney General, with penalties for violations ranging from USD 1,000 to USD 10,000.
