European Commission issued additional investigatory measures regarding X's recommender system in proceedings under Digital Services Act

On 17 January 2025, the European Commission introduced three additional technical investigatory measures related to X’s recommender system. First, the Commission requested X to provide by 15 February 2025 detailed documentation on its recommender system regarding content suggestions. Second, the Commission issued a retention order requiring X to preserve internal documents and information concerning planned changes to the design and operation of its recommender algorithms, covering the period between 17 January 2025 and 31 December 2025. Finally, the Commission requested access to the platform’s technical interfaces, including its commercial API, that enable direct fact-finding on content moderation and the virality of accounts.
