On 29 November 2021, the Shanghai Municipal Government adopted the Shanghai Data Regulations. The Regulations lay out the conditions under which rights to data and privacy must be respected. Notably, collection or processing of personal information requires individual consent and proper notification of the individual. The Regulations also place the collection of biometric information within specific limits, requiring necessity and consent. Further, the Regulations set out principles for the establishment of a data market and the further development of the digital economy. The Regulations will enter into force on 1 January 2022.
