Consultation closed on Shanghai Data Regulations Draft including data protection regulation
On 10 October 2021, the Shanghai Municipal Government closed the consultation on the draft Shanghai Data Regulations. The draft Regulations lay out the conditions under which rights to data and privacy must be respected. Notably, collection or processing of personal information requires individual consent unless required in order to comply with legal duties or the public interest. The Regulations also place the collection of biometric information within specific limits, requiring necessity and consent. Further, the Regulations set out principles for the establishment of a data market and the further development of the digital economy.
