On 30 September 2021, the Shanghai Municipal Government announced the publication of the draft Shanghai Data Regulations, at the same time opening a consultation on it. The draft Regulations lay out the conditions under which rights to data and privacy must be respected. Notably, the collection or processing of personal information requires individual consent unless required in order to comply with legal duties or the public interest. The Regulations also place the collection of biometric information within specific limits, requiring necessity and consent. Further, the Regulations set out principles for the establishment of a data market and the further development of the digital economy. The consultation will close on 20 October 2021.
