On 2 December 2026, Directive (EU) 2024/2831 on improving working conditions in platform work ("Platform Work Directive"), including regulation of employment status, was implemented. The Member States had until 1 December 2026 to transpose the Directive into national law. Under the Directive, the relationship between a digital labour platform and a person offering services via the platform is presumed to be an employment relationship when facts indicating control and direction are present. In cases where the presumption of employment applies, it will be the responsibility of the digital platform to demonstrate the contrary. Furthermore, the presumption can be triggered by the authorities’ initiative, worker or their representative.
