On 1 December 2024, Directive (EU) 2024/2831 on improving working conditions in platform work ("Platform Work Directive"), including regulation of employment status, enters into force with a grace period. The Member States are required to transpose and apply the requirements from 2 December 2026. Under the Directive, the relationship between a digital labour platform and a person offering services via the platform will be presumed to be an employment relationship when facts indicating control and direction are present. In cases where the presumption of employment applies, it will be the responsibility of the digital platform to demonstrate the contrary. Furthermore, the presumption can be triggered by the authorities’ initiative, worker or their representative.
