On 7 October 2024, the European Data Protection Board (EDPB) issued a statement on the draft regulation for additional procedural rules in enforcing the General Data Protection Regulation (GDPR). The EDPB listed several recommendations, including providing additional resources to the supervisory authorities (SAs), clarifying the complaints process with binding decisions on the admissibility of complaints and harmonizing settlement procedures across the EU. The EDPB warns against making settlements subject to national laws, which could hinder harmonisation. Concerns were raised about the proposed joint case file system, particularly regarding data security. The EDPB also suggests eliminating unnecessary procedural steps to streamline the urgency procedure in cross-border cases. Moreover, the EDPB questions the necessity of ex officio procedures and recommends clarifying the right to judicial remedies. Finally, the EDPB calls for better cooperation between the European Data Protection Supervisor and national authorities, alongside more flexible translation rules between SAs.
