Issued ruling in FTC lawsuit against Day Pacer and EduTrek for misusing consumer contact information

On 1 September 2023, the US District Court Northern District of Illinois Eastern Division issued a ruling in the lawsuit of the US Federal Trade Commission (FTC) against Day Pacer and EduTrek for misusing consumer contact information. The court found that the companies purchased contact information of consumers to make illegal and unsolicited phone calls about educational programs. The court also found that the companies aided other telemarketing companies to make calls to individuals who were placed on the National Do-Not-Call Registry. Lastly, the court found the individual defendants to be liable due to their direct participation or authority to control the business conduct. The court will schedule a hearing to determine the amount of civil penalty award as well as the scope of injunctive relief.
