On 17 October 2023, the Bill Securing and Regulating the Digital Space, including content moderation regulation, was passed by the National Assembly of France. The Bill aims to transpose obligations outlined in the European Digital Service Act (DSA) and the Digital Markets Act (DMA) to align national laws with these regulations. The Bill would require social media platforms to suspend the accounts of individuals convicted of cyberbullying and delete content depicting child pornography, Holocaust denial, terrorism promotion, or the dissemination of violent images. Furthermore, platforms will be restricted from exposing minors to targeted advertisements. Targeting based on sensitive data such as gender, ethnic origin, political or religious beliefs, sexual orientation, and others will also be prohibited. Non-compliance may result in fines of up to 6% of global revenue and potential prohibition from operating in Europe. The Bill will now be submitted to a joint committee of the two Houses responsible for examining and proposing a text on the provisions that remain under discussion.
