United States of America: Implemented Act on regulation of third-party data collection entities (SB 2105) including business registration requirement

On 1 September 2023, an Act on the regulation of third-party data collection entities (SB 2105), including business registration requirements, was adopted by the Texas House. The Act requires data brokers to register in order to operate in the state. Furthermore, descriptions of the data processing, contact information, and proof that the data collected is limited and for the intended purpose should be provided with the registration statement. Additionally, businesses are required to outline their minor data collection protocol and provide a log of their security breaches. The Secretary of State will include the businesses in a publicly searchable registry.
