Signed Act on regulation of third-party data collection entities (SB 2105) including business registration requirement

On 18 June 2023, an Act on the regulation of third-party data collection entities (SB 2105) including business registration requirements, was signed by the Texas Governor. The Act would require data brokers to register in order to operate in the state. Furthermore, descriptions of the data processing, contact information, and proof that the data collected is limited and for the intended purpose should be provided with the registration statement. Additionally, businesses are required to outline their minor data collection protocol and provide a log of their security breaches. The Secretary of State shall include the businesses in a publicly searchable registry. The Act will be effective as of 1 September 2023.
