United States of America: Adopted Act on regulation of third-party data collection entities (SB 2105) including business registration requirement

On 24 May 2023, an Act on regulation of third-party data collection entities (SB 2105) including business registration requirement was adopted by the Texas House. The Act would require data brokers to register in order to operate in the state. Furthermore, descriptions of the data processing, contact information, and proof that the data collected is limited and for the intended purpose should be provided with the registration statement. Additionally, businesses are required to outline their minor data collection protocol and provide a log of their security breaches. The Secretary of State shall include the businesses in a publicly searchable registry.
