China: Implemented Provisions on the Review of Concentration of Operators

On 15 April 2023, the Provisions on the Review of Concentration of Operators, adopted by China's State Administration for Market Regulation (SAMR) as one of four regulations supporting and implementing the amended Anti-Monopoly Law on 10 March 2023, came into effect. The Provisions define relevant merger situations, potential notification duties of parties involved in such mergers, and set out the oversight and enforcement process and exceptions that apply to merger situations.
