China: Adopted Provisions on the Review of Concentration of Operators

On 10 March 2023, China's State Administration for Market Regulation (SAMR) adopted the Provisions on the Review of Concentration of Operators, as one of four regulations supporting and implementing the amended Anti-Monopoly Law. The Provisions define relevant merger situations, potential notification duties of parties involved in such mergers, and set out the oversight and enforcement process and exceptions that apply to merger situations. The Provisions will be implemented on 15 April 2023.
