On 11 January 2022, an “Act concerning commercial Internet websites, consumers, and personally identifiable information and supplementing Title 56 of the Revised Statutes” (A. 1971) was introduced in the New Jersey General Assembly. The Bill would give consumers the right to opt out of the collection of their personal data, as well as the right to edit their data. Operators of online services would be required to inform consumers about the necessary process for editing and opting out of the collection of personal data. Consumers would also have to be informed about the type of information that is held, sold or disclosed to third parties. Operators of online services would be further prohibited from discriminating against consumers who opt out of the data collection practices of the entity. Protected health information would be excluded from the scope of the Bill. The New Jersey Attorney General would have exclusive authority to enforce the Act.
