Implemented Consumer Privacy Protection Legislation (S332/A1971) in New Jersey

On 16 January 2025, the "Act concerning commercial Internet websites, consumers, and personally identifiable information and supplementing Title 56 of the Revised Statutes” (S332/A1971) was implemented one year after its enactment. The Bill establishes a number of user rights, including giving consumers the right to opt out of the collection of their personal data, as well as the right to edit their data. Operators of online services will be required to inform consumers about the necessary process for editing and opting out of the collection of personal data. Consumers will also have to be informed about the type of information that is held, sold or disclosed to third parties. Operators of online services will be further prohibited from discriminating against consumers who opt out of the data collection practices of the entity. The Bill also limits the collection and processing of data by the controller. Protected health information will be excluded from the scope of the Bill.
