On 16 February 2023, the Texas Data Privacy and Security Act (HB 4) was introduced in the Texas House of Representatives. HB 4 is the companion act of HB 1844, introduced on 3 February 2023. The Act regulates the collection, processing, and treatment of personal data by entities collecting personal data. Small businesses, as defined by the US Small Business Administration, non-profit organisations, and higher education institutions are exempt from this Act. Under the Act, consumers would be able to request deletion, amendment, and opt-out of targeted advertising or sale of personal data. Data controllers must also establish an appeal process for a consumer to appeal the controller's refusal to take action on a request, failing which the controller must provide a method, online or not, for the consumer to contact the State Attorney-General to submit a complaint.
