On 10 May 2023, the Texas Data Privacy and Security Act (HB 4) was passed by the Senate of Texas. The HB 4 is the companion Act of HB 1844. The Act regulates the collection, processing, and treatment of personal data by entities collecting personal data. Small businesses, as defined by the US Small Business Administration, non-profit organisations, and higher education institutions are exempt from the obligations outlined in the Act. Under the Act, consumers would be able to request deletion, amendment, and opt-out of targeted advertising or sale of personal data. Data controllers must also establish an appeal process for a consumer to appeal the controller's refusal to take action on a request, failing which the controller must provide a method, online or not, for the consumer to contact the State Attorney-General to submit a complaint.
