On 26 January 2022, the public consultation closes on the Fair Trade Commission's (FTC) proposed Guidelines on the abuse of market dominance by online platform operators. The Guidelines outline the FTC approach for determining the entities that abuse their power and engage in unfair practices such as self-preferencing. The Guidelines list the practices platforms employ that allow them to have substantially more power than their multi-home platform counterparts. Furthermore, the FTC also elaborates on factors it will consider when investigating platforms, including tipping effects, multi-side characteristics, self-preferencing, most-favoured-nation clauses and bundling.
